Justice Musa Kakaki of the Federal High Court sitting in Ikoyi Lagos has adjourned till December 3, 2026 for hearing of application filed by the National Drug Law Enforcement Agency (NDLEA) seeking the final forfeiture of properties linked to a Lagos Socialite and Social Media Influencer Mr Afolabi Kazeem Michael also known as KC Luxury, and also an application filed by KC Luxury challenging the jurisdiction of the court to hear the forfeiture application.
The court had on the 25th of September 2026, granted a preservative order upon an exparte application filed by the prosecution for the forfeiture of properties and assets linked to the defendant Afolabi Kazeem Michael.
Upon granting the order, and as part of the order, the court directed the publication of the interim forfeiture order in a national daily and adjourned till October 14 for the report of compliance .
When the matter came up on Wednesday for report of compliance, the NDLEA prosecutor Abu Ibrahim Esq. told the court that the business of the court is a report of compliance of court order. “That is why we are here today”. He added that the prosecution has filed application for final forfeiture.
Afolabi and two others , Boniface Freeman Ochoche Sule and
Ikechukwu Ekugo Patriarch are currently standing trial before Justice Kakaki on a twenty two counts of trafficking 184.5 kg of cocaine, consequent upon which the anti- narcotic agency filed and obtained an interim forfeiture order over his identified properties and assets.
Consequently, the anti- narcotic agency filed and obtained an interim forfeiture order over his identified properties and assets.
However , Mr Afolabi Kazeem Michael represented by his counsel Chief Emefo Etudo Esq. informed the court that he has application before the court challenging its jurisdiction to issue forfeiture order.
Chief Emefo Etudor objected the submission of the prosecution for final forfeiture and told the court that he had an application challenging the jurisdiction of the court over the interim order of forfeiture. According him, this takes precedents over all applications before the court on the matter.
” My lord I was shown the publication about three days ago and has to rush to file our objection on jurisdiction.’
Etudor said that what the presecutor was trying to do is to make submission on what the foundation is being challenged.
They had obtained an order without given us opportunity to defend ourselves and property. Etudo said Section 36 of the constitution guarantees the right to property which can not be taken away without being given an opportunity to defend oneself and that is what NDLEA has done in this case , they went behind to obtain an order taking the defendant’s properties and assets without giving him opportunity to defend himself, that can not stand my lord.
After listening to parties, Justice Kakaki said he would hear both the application challenging the jurisdiction of the court as well as other application together. He adjourned the matter till December 3 to hear all the applications together.
