Supreme Court to hear Atiku, Obi, APM’s appeals Oct 23

By Emma Ogbuehi

The Supreme Court has scheduled a hearing for Monday, October 23, in the appeal filed by Atiku Abubakar, the candidate of the Peoples Democratic Party (PDP), in the February 25 presidential election.

The PDP candidate is challenging the September 6, judgment of the Presidential Election Petition Court (PEPC) which dismissed his petition against the victory of President Bola Tinubu in the February 25 presidential election.

TheNiche had earlier reported that The Supreme Court had fixed same date as the day it will hear the appeal lodged by the presidential candidate of the Labour Party (LP), Mr. Peter Obi and the Allied Peoples Movement (APM) against the tribunal judgement that affirmed President Bola Tinubu’s victory.

The appellants had 14 days from the date of judgement to file their appeal to challenge the verdict at the Supreme Court.

Obi and Atiku had filed separate petitions at the PEPC accusing Nigeria’s electoral umpire, INEC, and Tinubu of electoral malpractices. They contested Tinubu’s qualification to stand for election and urged the PEPC to set aside the election.

But the court, in its decision, held that they failed to substantiate their claims of electoral fraud against INEC and the president.

The five-member panel headed by Justice Hassan Tsammani on September 6 dismissed the petitions filed by Atiku and his Labour Party counterpart, Peter Obi, for lack of merit.

Recall the PDP candidate on September 19 filed 35 grounds appeal challenging the verdict of the presidential election petitions which upheld Tinubu’s victory in the election.

The former Vice President had also applied to the Supreme Court to file fresh evidence obtained from the Chicago State University against the president.

Atiku has continued to insist that Tinubu’s academic records are fraught with discrepancies and forgery and asked the apex court to kick him out of office.
