Deap Capital Plc, UNIC Insurance Plc are among 94 capital market operators listed for withdrawal of their operating licences for inability to meet with regulatory obligations and perform various functions for which they were licensed.
Apart from being an underwriter, UNIC Insurance is a corporate investment adviser, fund/portfolio manager but, according to Securities and Exchange Commission (SEC), has been inactive and supplied no information to confirm their shareholders fund.
Deap Capital Management & Trust Plc also listed for withdrawal of their operating licence is a fund/portfolio manager and an issuing house which the capital market apex regulator said has been inactive and currently on suspension.
In a notice posted on its website on Friday titled ‘Pre-notice on Cancellation of Certificates of Registration of Inactive Capital Market Operators’, SEC listed 94 Capital Market Operators (CMOs) that may lose operating certificates of registration to perform various functions in the Nigerian capital market after this December 4 unless the firms prove otherwise.
According to Mounir Gwarizo led SEC, the firms failed to meet up with September 30 deadline for new minimum capital requirement even as some have been Inactive and could not perform the functions for which they were registered.
“These capital mark operators have consistently failed to render their statutory returns to the Commission and may have been unable to comply with the new minimum capital requirements before the deadline stipulated by the Commission which expired on 30th September, 2015.
“In view of this fact, the Commission hereby directs the affected CMOs to make presentations to the Commission, on or before 4th December, 2015, giving reasons why their registration as CMOS should not be cancelled,” the notice stated.
The apex capital market regulator had earlier fixed September 30 as recapitalisation deadline with the provision that affected operators would only apply for fresh registration to operate in the Nigerian capital market.
The affected companies which are into Corporate Investment Advisers, Solicitors, Reporting Accountants, Issuing Houses, Receiving Bankers, FMDQ OTC Dealers, Broker/Dealers, Registrars, Fund /Portfolio Managers, Rating Agencies, Trustees, Underwriters, Custodians, and Venture Capital Managers are:
