Nigerian Judge takes a rare step, recuses self from high profile case to ensure fairness in adjudication

A Judge, citing personal interest, has taken a rare step in Nigerian judiciary to recuse herself from a months-long legal battle between Grandscope Construction Company and Emir General Integrated Limited at a High Court in Gombe.
Judge Fati Musa announced her withdrawal during a court session, saying personal interest could influence her judgment, and had to step down to ensure fairness in adjudication.
She directed the case file be forwarded to the Chief Judge for reassignment to another Judge.
Daniel Tsaro, counsel to Grandscope Construction Company, commended her decision, calling it a responsible step that reinforces judicial integrity.
“This isn’t just unprecedented. Her action shows dedication to impartiality,” Tsaro said.
Suleiman Abdurrahim, representing Emir General Integrated, also supported the withdrawal, acknowledging the Judge’s right to step aside if objectivity might be compromised.
He disclosed that his legal team had filed for a court injunction to halt ongoing construction on the disputed land.
The dispute began over four months ago, originating from a court order mandating Grandscope Construction Company to cease construction activities on the property.
Allegations of non-compliance with the order have since escalated the dispute.
The land, located along the important Gombe-Bajoga Highway, has attracted public interest and legal scrutiny.
Both parties await the reassignment of the case and have expressed confidence in a fair resolution moving forward.
