Adamawa APC hails Appeal Court judgment on ex-Gov Nyako

-

The All Progressives Congress (APC) in Adamawa State has applauded the verdict passed on ex-Governor Murtala Hammanyero Nyako over his unconstitutional impeachment, saying the verdict has exonerated him from all allegations levelled against him by the anti-graft agencies.

The Federal Court of Appeal, Yola Division in Adamawa State on February 11, nullified the impeachment of former Governor Murtala Nyako in the judgment delivered by a panel of five judges led by Justice Jumai Hannatu Sankey.

The panel in a unanimous judgment, described Nyako’s impeachment as a high level of impunity, recklessness, rascality and gross abuse of legislative powers of the Adamawa State House of Assembly.

They condemned in unequivocal terms the gross abuse of legislative powers by the lawmakers to achieve orchestrated, premeditated and selfish motives.

They said that the impeachment of the former governor was a misuse of the powers and privileges of the legislature and declared the impeachment as null, void and of no effect.

Justice Tunde Awotoye, delivering his judgment, noted that the respondents took laws into their hands as they flagrantly abused the Constitution of the Federal Republic of Nigeria to meet their whimsical and selfish desires.

In a statement on Sunday, Alhaji Umaru Mijinyawa Kugama, APC Board of Trustee (BOT) member in the state, said that the judiciary is living up to the expectations of the people, adding that the judgment also proved that the ex-governor was being witch-hunted by the PDP-led administration for telling them the truth and decamping to the APC.

The statement added that PDP in their quest to capture Adamawa by all means, thought that if they dislodged Nyako, it would be easy for them to capture the state, not knowing that the ex-governor performed creditably well, such that even while he was away in exile, his party structure produced Governor Jibrilla Bindow and other senators including his son Abdul-Aziz Nyako, who won the elections based on his arrangement with the people in the state, the statement said.
