NJC directs Uzodinma to reverse Nzeukwu’s appointment as acting CJ, most senior High Court Judge to replace him

Imo Governor Hope Uzodinma has been directed by the National Judicial Council (NJC) to reverse the appointment he made of Theophilus Nzeukwu as the acting Chief Judge (CJ) of the state.
The NJC, at its 108th meeting which ended in Abuja on Wednesday, also directed Uzodinma to appoint the most senior Judge in the State High Court hierarchy as the acting CJ in conformity with Section 271 (4) of the Constitution.
A statement issued late on Wednesday by NJC spokesperson Kemi Ogedengbe Babalola said the NJC insists that the constitutional provision on the appointment of an acting state CJ does not give room for discretion.
The statement added that:
- Nzeukwu should be issued a query to show cause within seven days why disciplinary action should not be taken against him for presenting himself to be sworn in as acting Imo CJ.
- Imo Customary Court of Appeal President V. U. Okorie, who acted as interim Chairman of Imo State Judicial Service Commission and recommended the appointment of Nzeukwu, should also show cause within seven days why disciplinary action should not be taken against him for his complicity in the recommendation.
