Emefiele: Court dismisses Sa’adatu Yaro’s suit seeking fundamental rights enforcement

Sa’adatu Yaro, a staff of the Central Bank of Nigeria accused of fraudulent dealings along with the suspended apex bank Governor, Godwin Emefiele, has lost a fundamental rights suit she filed against the Department of State Services (DSS).
A Federal Capital Territory (FCT) High Court, Abuja on Friday, dismissed the fundamental human rights suit.
Yaro is the second defendant in the N6.9billion procurement fraud charge filed against the suspended CBN governor, Godwin Emefiele by Federal Government through the office of Attorney-General of the Federation
Her absence from court last Thursday as a result of ill health stalled her arraignment with Godwin Emefiele hence the adjournment of the case to August 23 for arraignment.
In the fundamental rights enforcement suit numbered FCT/HC/CV/6918/23, Yaro sought an order releasing her six exotic cars seized by the DSS on July 12 as well as bail from continued detention.
In a motion on notice filed through her counsel, Joseph Bodurin Daudu (SAN), she prayed the court to declare her arrest on July 12, 2023, the detention of her husband and seizure of her six exotic cars as an infringement on her fundamental human rights.
Daudu (SAN) further argued that the DSS, not being an anti-graft agency, lacked jurisdiction or statutory powers to inquire into Yaro’s business dealings.
He said the continuous detention and torture of the applicant by the DSS since the 12th day of July 2023 violates the applicant’s Right to Dignity of Human Person and Right to Personal Liberty guaranteed by Sections 34 and 35 of the 1999 Constitution of the Federal Republic of Nigeria.
