Delta guber victory: Okowa thanks God, urges Ogboru, O’tega to sheathe swords

Delta State Governor Ifeanyi Okowa on Thursday expressed gratitude to God for giving him victory at the Court of Appeal in Abuja.

The governor, who marked the victory at the Government House Chapel, Asaba, few hours after the court ruling, called on Chief Great Ogboru and Chief Emerhor O’tega, his opponents to sheathe their swords and join his government.

NAN reports that Ugboru, the governorship candidate of the Labour Party and O’tega of the All Progressive Congress (APC), contested the April 11 elections with Okowa.

Both petitioned the elections tribunal in Asaba against the governor’s victory.

Dissatisfied with tribunal’s affirmation of the victory, the candidates proceeded to the Court of Appeal which further affirmed the governor’s victory on Thursday.

According to Okowa, the battle has been fierce in all angles and the rumours have been strong.

“But this is time for peace and not for war; the war is over and it is time for us to think about Delta and not about our self.

“And it s time for repentance and I call on Ogboru and O’tega to come back and embrace this government so that together we can work for the good of Deltans.”

He described the season as a perfect Christmas because the people came out to vote and the lower and the appeal courts have upheld their votes.

He assured the people that his administration would not let them down.

In his reaction, Sen. James Manager attributed Okowa’s victory to God and appealed to the opponents to join him to salvage the state.

“For those who lost in the elections even at the tribunal and Court of Appeal should give peace a chance in the overall interest of Delta.

“I know that there is still another leg, but must we push it that far? Is it necessary in the interest of our people?

“Let us come together to build Delta from the current level to where we want it to be?” Manager appealed.

 

Appeal Court dismisses Ogboru’s appeal against Okowa

The Abuja Division of the Court of Appeal, has dismissed the appeal  lodged against the election victory of Governor Ifeanyi Okowa of Delta State by Labour Party (LP) candidate‎ in the April 11 governorship election in the state, ‎Chief Great Ogboru.

In a unanimous judgment, a five-man panel of Justices of the appellate court led by Justice ‎Uwani Abba-Aji upheld the verdict of the Delta State ‎Governorship Election Petition Tribunal which on ‎October 24, ‎affirmed Okowa’s victory.

The appellate court said the tribunal was right when it ‎held that the petitioner failed to prove that the governorship election was characterised by over-voting and manifest corrupt practices.

Besides, the Appeal Court panel maintained that Ogboru could not prove that the election was not conducted in substantial compliance to both the Electoral Act, 2010 and the Election Guidelines and Manual ‎that the Independent National Electoral Commission (INEC) issued for the purpose of the election.

“Where in election petition, there are allegations of irregularities and corrupt practices, the allegation ‎must be proved beyond every reasonable doubt”, the court held.

It stressed that a petitioner challenging the outcome of an election on ground of irregularity, must show that ‎such irregularity substantially affected the outcome of the election.

The appellate court held that Ogboru failed to prove that but for the alleged corrupt practices, he would have won the Delta State governorship election.

Consequently, the appeal was dismissed for want of merit.

Ogboru had approached the appellate court, praying it to set aside the judgement of the tribunal.

‎He contended that ‎the total number of votes recorded at the end of the election, far exceeded the number of voters accredited by the card reader machines.

The appellant sought for the nullification of the governorship election and the declaration of a fresh poll in the state.

However, while refusing his prayers, Justice Abba-Aji ‎who read the lead judgment, held that Ogboru merely relied on records of the card reader accreditation, without demonstrating the documents through credible evidence.

Justice Abba-Aji noted that the LP candidate never challenged the evidence of the respondents laid before the tribunal.

She observed that even witnesses Ogboru brought before the lower tribunal testified that the the card readers had challenges in many parts of the state and that apart from the use of card reader, there was also manual accreditation.

The court held that the appellant ought to have established that the card reader machines functioned optimally in all the polling units in the state, before placing sole reliance on the card reader report.

Meantime, the appeal court has also dismissed three separate cross-appeals that were filed before it by Okowa, the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC).

The court held that the three appeals which also arose from the judgement of ‎the tribunal, lacked merit.

Judgment is currently ongoing in a separate appeal that was lodged against Okowa by the All Progressives Congress (APC) and its own governorship candidate in the state, ‎Olorogun O’tega Emerhor.
