A Grade 1 Area Court in Aso Pada, Mararaba, Nasarawa State, on Monday struck out a case of trespass against a Landlord, John James.
The landlord was charged with a one-count of trespass on Oct. 6.
The presiding judge, Mr Albert Maga, struck out the case after the prosecutor, Cpl Friday Adaji, told the court that all parties had agreed to settle the matter out of court.
Maga, therefore, discharged the landlord.
“Based on the reconciliation made by the complainant and the accused person to live in peace with each other, the case is hereby struck out and the accused person discharged.
“The accused person should write an undertaking that he will not fight or lock his tenants’ room again without their knowledge but live in peace,” Maga said.
He also admonished him never to be involved in a similar act as the court would not take it lightly with him next time.
The prosecutor had told the court that on Oct. 6 at about 8.30 am, Ogu Chukwu of ECWA 2, Aso Park, Mararaba, lodged a complaint against the landlord at the Aso Pada Police Station.
He said Chukwu alleged that on the same day when he went to work, he returned to discover that the landlord broke his padlock and put a new one without his knowledge.
The prosecutor said that the landlord locked out the complainant for 2 days.
According to him, the offence contravened Section 345 of the Penal Code.
The accused pleaded not guilty.
