Court orders final forfeiture to FG of cars, money belonging to drug trafficker

Justice Nicholas Oweibo of the Federal High Court, Lagos, has granted an order of final forfeiture of a Honda Accord car and another Scania Truck Peugeot car as well as all the monies in Ecobank account number 2951023182 and Sterling Bank account number 0011665893 all belonging to a convicted drug trafficker, Nnameka John Nwaozor to the Federal Government of Nigeria.

The final forfeiture order was sequel to an ex-parte application filed and argued by Barrister Umar Hussaini of the National Drug Law Enforcement Agency, NDLEA.

In granting the order, Justice Oweibo agreed with the submission of the NDLEA counsel, Umar Hussaini that the two cars and the monies in the bank accounts of Nnaemeka are all proceeds of crime.

Recall that John Nwaozor Nnameka and Levi Onwubiko Nwogu had earlier been arraigned before Justice Justice Nicholas Oweibo of the Federal High Court, Lagos on a three counts charge of illegal possession of 1.155 kilograms of cocaine and were sentenced to 8 years imprisonment or a fine of two million naira each.

Following the conviction, Umar filed a motion for the temporary forfeiture of the cars and monies which was granted and later the final forfeiture.

The charge against Nnameka and Nwogu reads: “That you John Nwaozor Nnameka and Levi Onwubiko Nwogu without lawful authority conspired to possess 1.55 kilograms of Cocaine, a substance similar to Heroin and LSD, thereby committed an offence contrary to and punishable under Section 14 ( c) of the NDLEA Act Cap N30, Laws of the Federation of Nigeria 2004 ( As amended).”
