Accuser withdraws Mike Tyson rape case, expresses disappoint at refusal on procedural grounds

A lady who alleged former world heavyweight boxing champion Mike Tyson raped her has withdrawn her lawsuit over the refusal of United States District Court to allow her file amended pleadings.

Tyson previously served three years in prison following a separate rape conviction in 1992.

In the latest case, the plaintiff’s attorney in a letter filed in the court informed Tyson’s lawyer, Daniel Rubin, that she was voluntarily dismissing her complaint. The March 7 correspondence, addressed to Judge Mitchell Katz, was first reported by USA Today.

The accuser’s legal representatives expressed disappointment over the court’s refusal to permit amendments to the pleadings.

“We are extremely disappointed that the court did not allow us to amend the pleadings in the case. It’s a shame our client’s case had to be dismissed on procedural grounds,” attorney Darren Seilback said in a statement.

 “We stand by our client’s account of the events and support her 100%.”

Filed under New York’s Adult Survivors Act, the lawsuit had alleged that Tyson raped the woman in a limousine after they met at a nightclub in Albany in 1991. She claimed to have endured lasting emotional and physical trauma from the incident.

Tyson has consistently denied the allegations.

His legal team has yet to issue further comments on the latest development.
