Abayomi backs Tinubu’s proclamation on Rivers, says it’s constitutional

A Renowned constitutional lawyer and human rights activist, Dr Tunji Abayomi has described President Bola Ahmed Tinubu’s proclamation of a state of emergency in Rivers State as constitutional

In a statement issued today in Akure, the Ondo State capital, Abayomi said section 305 replaces a normal order which is presumed to be existing with an abnormal order brought about by the abnormal situations listed in 305 (3) (a) to (g).

According to him, the prerogative to decide that the basis to issue a proclamation of a State of Emergency in any part of the Federation belong exclusively to the President but the prerogative to declare a State of Emergency is shared with National Assembly which must approve by two third majority.

Abayomi added that once a proclamation is made and is approved, the President takes over governance in any part of the Federation affected for the period of the emergency.
