Zamfara Governor-elect won’t get Certificate of Return, says INEC

The Independent National Electoral Commission (INEC) has said that it has been served with the Judgment of the Court of Appeal which nullified the primary of the All Progressives Congress (APC) in Zamfara State, hence it would not issue Certificate of Return to the Governor-Elect, Muktar Idris, and all members of the House of Assembly who won their election on the platform of the party.  

The Court of Appeal Sokoto Division had on Monday, March 25, set aside the judgment delivered by the Zamfara High Court which allowed the APC to field candidates in the 2019 elections in Zamfara State after INEC initially disqualified the ruling party.  

The appeal was filed by Senator Kabiru Marafa.

The three-man panel of judges was unanimous that the lower court failed in its duty to properly evaluate the evidence before it.

The lead judgement was delivered by Justice Tom Yakubu.  He said; “Based on available facts, the respondents did not contradict the INEC evidence on conducting the said primary election,” Yakubu said.

He added that the judgment should serve as “bitter lesson” for political parties as they ought to follow legitimate guidelines and rules.

“Domestic affairs of political party activities must act within the confines of the law in dealing with party members and elections,” the judges agreed.
