Upon his failure to produce a defendant whom he surteed before the Federal High Court in Lagos, a surety Mr Nurudeen Olusesi was on Wednesday arraigned before Justice Ibrahim Ahmad Kala.
The surety was arraigned by the Police Special Fraud Unit (PSFU) on Wednesday,
He was charged on a two-counts charge bordering on alleged failure to produce one Ekene Ozoemena.
When the case was called, Mr Chukwu Agwu appeared for the prosecution, while Mr I.O Lale appeared for the defendant.
After listening to the charge which was read to him, the defendant pleaded not guilty.
Following his plea, the court fixed May 23 for hearing of his bail application and ordered that he be remanded in custody pending bail.
In the charge, the prosecutor told the court that the defendant committed the offence on January 15, February 6 as well as other subsequent dates, by failing to produce the said Ozoemena for whom he stood surety.
According to the charge, the defendant conspired with Ozoemena to obstruct and pervert the cause of justice, by failing to produce him for arraignment in a criminal charge pending before the court.
The prosecutor said that the defendant stood surety for Ozoemena on June 21, 2022, at the SFU in Lagos, over a case of fraud by obtaining the sum of N121 million under false pretence and money laundering.
He was said to have obstructed, perverted and prevented the course of justice by refusing to produce Ozoemena.
The offence contravenes the provisions of Sections 126(1) of the Criminal Code Law of the Federation, 2004.
While adjourning the case to May 23 for hearing of his bail application, the court also fixed June 27 for arraignment of Ozoemena.
